The Deadline for ALL workplaces to comply was June 2006. However, even now (Spring 2008) it is likely that no more than 50% of sites are fully compliant. The UK HSE has ruled that all landfills comprise workplaces. Even closed landfills are workplaces for the purpose of monitoring the gas and leachate wells.

Make sure you have an adequate induction and training plan to ensure all new staff work safely on your site from day one, as required by the regulations.

The
regulations require the following to be addressed during the DSEAR risk assessment, and in the Explosion Protection Document produced.:
i. Prevent the formation of explosive atmospheres in the
workplace
OR
Avoid the ignition of explosive atmospheres
and
Control the effects of explosions;
ii. Conduct a risk assessment covering:
● The
likelihood of explosive atmospheres occurring and their persistence
● The
likelihood of a source of ignition
● The effect
of an ignition on plant, personnel and the environment;
iii.
Classify the work place into Zones (or state that no hazardous zones exist in
which case none of the further actions in this list apply);
iv. Marking of areas with signs at points of entry;
v. Maintenance of an explosion protection document including:-

assessment and identification of zones.

● documentation of
requirements for training staff and instituting a system of permits to work;
vi. Select ATEX 100a compliant equipment according to intended
zone
Who is responsible for Compliance?
The Employer is responsible, but it is generally best if the Site Manager produces the Risk Assessments, and the Explosion Protection Document, and then manages the completion of all necessary actions to ensure compliance.
The first time a Site Manager carries out this work he will normally need some training. Expert consultants offer this training.
